Constitution

ARTICLE I: ORGANIZATION NAME
No names other than Residence Hall Association of Montana State University-Bozeman, RHA, RHA-MSU, RHA-MSU-Bozeman, Interhall RHA, IRHA, IRHA-MSU or IRHA-MSU-Bozeman shall be used to designate the Residence Hall Association of Montana State University.
ARTICLE II: PURPOSE
In accordance with ARTICLE II of the RHA Constitution, RHA shall take action in accordance with the ultimate goal of assisting the improvement of the quality of life for students living within the residence halls.
SECTION I
The IRHA Legislature shall act as the primary platform of representation for the RHA membership and will meet on a regular basis. The IRHA Executive Council will act as the immediate liaison with other groups, organizations and administrations both on and off campus.
SECTION II
Part A - Each hall RHA will be responsible for providing a variety of activities on a regular basis for the residents of the hall or for the residents of campus. Each hall RHA shall also be responsible for maintaining desired services and designated service areas for the residents of the hall at the hall front desk. Each hall RHA may extend or rescind individual services with a simple majority vote (51%) of the hall's RHA Membership (residents).
Part B - Interhall RHA will provide a variety of activities and services, with the assistance of the individual hall RHAs throughout the course of the academic year.
SECTION III
Part A – Each hall RHA will provide an equal opportunity for residents to be involved in the planning and participation of hall activities. Hall RHA Executive Council members shall have the opportunity to serve on committees as they arise at both the hall and Interhall level. Each Hall RHA Executive Council may engage in one (1) hall leadership retreat per semester.
Part B – Interhall RHA will provide leadership development events each year with the assistance of the individual hall RHAs. Interhall RHA Executive Council members shall have the opportunity to serve on committees as they arise at the Interhall level. The Interhall RHA Executive Council may engage in one (1) Executive Council retreat per semester.
ARTICLE III: MEMBERSHIP
SECTION I
The social fee is included in any on-campus student's fee statement.
SECTION II
All members can vote in any election that requires a vote of the RHA membership.
ARTICLE IV: AFFILIATION
SECTION I : Regional and National RHA Affiliations
MSU-Bozeman RHA's affiliation with NACURH and IACURH is maintained yearly through the payment of dues. It provides MSU-Bozeman RHA the opportunity to have representation within the regional and national RHA levels. In addition, the resources afforded all member schools is also bestowed upon RHA at MSU-Bozeman.
SECTION II : National Residence Hall Honorary (NRHH) Affiliation
MSU-Bozeman RHA is also affiliated with the National Residence Hall Honorary.
SECTION III : MSU Department of Residence Life Affiliation
RHA works in conjunction with the Department of Residence Life to insure that the two organizations are not counterproductive in their mission to improve on-campus living. Advisors at the floor, hall and Interhall RHA level are employed with the Department of Residence Life.
ARTICLE V: ORGANIZATION OF GOVERNMENT
SECTION I : Floor RHA
Part A – Floor RHA President Job Description
  1. Will determine floor officers necessary for carrying out the functions and business of the respective floor(s) under the advisement of the floor Resident Advisor (RA).
  2. Will attend as many meetings possible on his/her respective floor(s).
  3. Will represent his/her respective floor(s) at all Hall Legislature meetings.
  4. Will promote legislation as it is necessary and proper for the benefit of the students of the respective floor(s) and of RHA.
  5. Will serve as a key resource and liaison to the Hall Legislature.
  6. Will hold a good working relationship with the RAs and will keep them informed of all floor and hall activities.
  7. Will be accountable to the Hall RHA President for anything pertaining to Hall RHA.
  8. Will work with the Hall RHA Treasurer as necessary.
Part B – Floor RHA Vice President Job Description
  1. Will resume duties of Floor President in any and all of his/her functions if he/she is unable.
  2. Will represent the respective floor(s) at all Hall Legislature meetings.
  3. Will serve as a member of a Residence Hall Judicial Board (J-Board) and will be required to attend all J-Board meetings.
  4. Will be accountable to the Hall RHA Vice President for anything pertaining to the Hall RHA.
  5. Will aid the Floor President in all decisions made for the benefit of the floor(s) residents.
SECTION II : Hall RHA
Part A – Hall RHA President Job Description
  1. Will be the Chief Executive Officer of the Hall RHA and will be willing to express the news, ideas, and interests of his/her presiding hall.
  2. Will hold regular meetings for the Hall RHA Executive Council.
  3. Will be the chairperson of the Hall Legislature meetings and all related responsibilities.
  4. Will only vote when the count comes to a tie vote. He/She is to vote in the best interest for the hall that he/she resides in.
  5. Will be responsible for holding regular monthly meetings with all the Floor Presidents of the hall.
  6. Will announce, in proper sequence, the business that comes before the Hall Legislature and compose the meeting agendas (with the assistance of the Hall RHA Advisor and others).
  7. Will be available for any Hall resident who wishes to share or discuss any hall-related topic or problem.
  8. Will discuss and confer regularly with the floor RA to insure proper running of the entire Hall Legislature.
  9. Will oversee and participate in all functions put on by the specific hall RHA in which he/she presides.
  10. Will be the preferred replacement in the place of a Senator who is absent from the RHA Legislature.
  11. Will promote such legislation as it is necessary and proper for the benefit of the members of the RHA.
  12. President's responsibilities while running a Hall Legislature meeting:
    1. Will recognize members wishing to speak in an unbiased fashion.
    2. Will state and put to vote all questions that legitimately come before the assembly as motions or that otherwise arise in the course of the proceedings, and to announce the result of each vote; or, if a motion is not in order, to rule it out of order.
    3. Will enforce the rules relating to debate and to order and decorum within the assembly.
    4. Will expedite business in every way compatible with the rights of the members.
    5. Will respond to inquiries of members relating to parliamentary procedures or factual information bearing on the business of the assembly.
    6. Will turn the chair over to the Vice President or appropriate temporary occupant if the President wishes to take part in the debate.
    7. Will declare the meeting adjourned when the Hall Legislature members so vote; or, where applicable, at the time prescribed in the agenda or at any time in the event of a sudden emergency affecting the safety of those present.
  13. Follow-up with hall RHA Executive Council members and RHA committees as necessary to insure the timely and proper completion of tasks and responsibilities.
Part B – Hall RHA Vice President Job Description
  1. Will be the chairperson of the Hall Judicial Board.
  2. Will act in the absence of the President as needed.
  3. Will work with and maintain regular communication with the Hall RHA President in any matters concurrent to hall matters.
  4. Will be responsible for the advertising and carrying out all elections and position searches for the Hall Executive Council.
  5. Will be required to attend the Hall Executive Council meetings.
  6. Will be required to attend Hall Legislature meetings and be responsible for the attendance of Floor Vice Presidents.
  7. Will take on any other duties requested by the Hall RHA President.
  8. Will be a member of the Interhall Judicial Appellate Board.
Part C – Hall RHA Secretary Job Description
  1. Will be the recording officer of the Hall Executive Council and the custodian of its records, with the exception of those specifically assigned to others, such as the Treasurer's books.
  2. Will keep the organization's official membership roll and will call roll when it is required.
  3. Will record and maintain minutes of all meetings and documents of the Hall Legislature within the time frame specified by the Hall RHA President.
  4. Will type, distribute, and post agendas, minutes, reports, and other materials as needed.
  5. Will send a copy of minutes to all Hall Legislature members upon request.
  6. Will maintain record book(s) in which the Constitution, Constitutional By-laws, special rules of order, standing rules and minutes are entered, with any amendments to these documents being properly recorded.
  7. Will have the current record book(s) on hand at every meeting.
  8. Will conduct all necessary correspondence.
  9. Will be responsible for a general attendance of all RHA members at all meetings.
  10. Will be required to attend Hall Executive Council meetings.
  11. Will be required to attend all Hall Legislature Meetings.
  12. Will notify officers, committee members and delegates of their election or appointment.
  13. Will furnish committees with whatever documents are required for the performance of their duties and to have on hand at each meeting a list of all existing committees and their members.
  14. Will have on file copies of necessary floor/election forms (i.e., petitions, ballots, etc.)
Part D – Hall RHA Treasurer Job Description
  1. Will be responsible for the hall's finances and their record keeping
  2. Will be responsible for creating and maintaining a hall budget
  3. Will be required to attend every Hall RHA Executive Council meeting
  4. Will be required to attend every Hall Legislature meeting
  5. Will be required to maintain an up to date and accurate account of hall's finances.
  6. Will be required to offer a financial report once a month at both the Hall RHA Executive Council or Hall Legislature meetings.
  7. Will work closely with the IRHA VP of Business, IRHA Advisor, Hall RHA Advisor and Resident Director to ensure proper bookkeeping procedures.
  8. Will be responsible for paying all Hall bills using the appropriate procedures
  9. Will be required to meet weekly with the hall Resident Director and Hall RHA Advisor to look over books and sign BPAs (Banner Payment Authorizations).
  10. Will be responsible for completing the monthly reconciliation in conjunction with the Hall RHA Advisor.
Part E – Hall RHA Interhall Representative Job Description
  1. Will serve in a dual role as a member of the IRHA Executive Council and as a member of the hall RHA.
  2. Will act as liaison or link between his/her hall RHA Executive Council and the IRHA Executive Council by keeping the hall RHA informed of Interhall RHA affairs and likewise, keeping the Interhall RHA informed of hall-wide affairs.
  3. Will be required to attend Hall RHA Executive Council meetings.
  4. Will be required to attend Hall Legislature meetings.
  5. Will be required to attend all IRHA Executive Council meetings.
  6. Will coordinate hall-wide resources as needed to assist Interhall RHA under the advice of the Hall RHA President and Hall RHA Advisor.
Part F – Hall RHA Senator Job Description
  1. Will be a voting member of the IRHA Legislature who will represent the views and ideas of the hall he/she represents.
  2. Will act as liaison or link between his/her hall RHA and IRHA Legislature by keeping the hall informed of Interhall RHA activities and taking problems to the Interhall RHA as necessary.
  3. Will be required to attend Hall RHA Executive Council meetings.
  4. Will be required to attend Hall Legislature meetings.
  5. Will participate in decision-making within his/her hall and at the Interhall level. He/she should be aware of the views, ideas, interests and needs of the residents of his/her hall.
  6. Will be expected to report to the Hall Legislature meetings a summary of minutes from the last IRHA Legislature meeting. These will be presented orally, then given to the Hall RHA President to be recorded.
  7. Will inform hall of activities happening in other halls to give support and to participate.
  8. Will report suggestions, ideas and criticisms from the hall residents before the appropriate legislature so that the proper action can be taken.
  9. Will vote the wishes of hall residents during the IRHA Legislature Meetings, but will vote in accordance with what is best for the entire campus community, if necessary.
SECTION III : Interhall RHA
Items approved for discussion at Interhall Legislature meetings must first be proposed, in writing, to the IRHA Executive Council meeting directly preceding the meeting in which the item shall be presented. The IRHA Executive Council may address the Legislature with any issues discussed prior to the Interhall Legislature meeting.
ARTICLE VI: IRHA EXECUTIVE COUNCIL
SECTION I : Officer Position Descriptions
Part A – IRHA President Job Description
  1. Will preside over the Interhall Legislature meetings
  2. Will sit as ex-efficio, non-voting member of all IRHA committees.
  3. Will be an official representative of RHA on any and all occasions where necessary.
  4. Will promote such legislation as is necessary for the advancement of efficient and responsible government.
  5. Will cast a deciding vote in the case of a tie at Interhall Legislature meetings
  6. In cooperation with Interhall RHA and under advisement of the Interhall RHA Advisor, will conduct a leadership workshop/retreat each semester.
  7. Will take an active interest in the activities of all the halls.
  8. Will regularly meet with the Interhall RHA Advisor.
  9. Will attend all Interhall RHA Executive Council meetings.
  10. Will attend all Interhall Legislature meetings.
  11. Will attend a different hall RHA meeting each week.
  12. Will assist the NCC, as needed, with the preparation for all major conferences and business meetings.
  13. Will assist in the training of all hall RHA Presidents
  14. Will maintain and encourage communication between hall RHA presidents through scheduled group meetings.
  15. Will follow-up with IRHA Executive Council members and IRHA committees as necessary to insure the timely and proper completion of tasks and responsibilities.
  16. Will perform all necessary acts to further the development of residence hall living.
Part B – IRHA National Communications Coordinator
  1. Will be an official representative of RHA on any and all occasions as necessary (esp. at regional and national conferences).
  2. Will act as the liaison between MSU-Bozeman RHA and other regional and national RHAs (IACURH, NACURH, etc.)
  3. Will serve as the voting delegate to IACURH and NACURH on behalf of MSU-Bozeman RHA.
  4. Will submit National Information Center (NIC) annual reports by the deadlines specified in the NACURH By-laws.
  5. Will coordinate the creation and submission of all bids from the MSU-Bozeman RHA as advised by the Interhall RHA Advisor.
  6. Will regularly meet with the Interhall RHA Advisor.
  7. Will attend all Interhall RHA Executive Council meetings.
  8. Will attend all Interhall Legislature meetings.
  9. Will perform all necessary acts to further the development of residence hall living.
Part C – IRHA Vice President of Personnel Job Description
  1. Will serve as the chairperson of the Interhall Appellate Judicial Council.
  2. Will serve as an advisor of hall judicial councils if requested to do so.
  3. Will assist in training Hall J-Boards, including Hall RHA Vice Presidents.
  4. Will maintain contact with Hall RHA Vice Presidents through scheduled group meetings.
  5. Will advise all committees upon request of the IRHA President.
  6. Will determine election procedures for elections and will act as the chairperson of any IRHA election committees or election appeals committees.
  7. Will compile and distribute semester lists of Hall and Interhall RHA Executives.
  8. Will regularly meet with the IRHA Advisor.
  9. Will attend all Interhall Legislature meetings.
  10. Will attend all IRHA Executive Council meetings.
  11. Will perform all necessary acts to further the development of residence hall living.
Part D – IRHA Vice President of NRHH Job Description
  1. Will preside over NRHH meetings.
  2. Will conduct monthly NRHH meetings and notify all current members regarding the meeting date, time and location.
  3. Will assume responsibility for publicizing the Of The Month (OTM) process and soliciting OTM writing.
  4. Will maintain communication with the regional and national NRHH organizations.
  5. Will be responsible for insuring all OTMs are submitted properly and on schedule with the established timeline(s)
  6. Will coordinate the NRHH Of The Year Awards process and banquet/ceremony as advised by the IRHA President and Advisor.
  7. Will act as the chairperson of the IRHA Of The Year Awards selection committee as advised by the IRHA Advisor.
  8. Will uphold the NRHH Constitution and ensure it is current and up to date.
  9. Will regularly meet with the IRHA Advisor.
  10. Will attend all Interhall Legislature meetings.
  11. Will attend all IRHA Executive Council meetings.
  12. Will perform all necessary acts to further the development of residence hall living.
Part E – IRHA Vice President of Programming Job Description
  1. Will advise all committees regarding activities and programming upon the request of the IRHA President.
  2. Will assist in the training of Hall RHA Social Chairs (if applicable).
  3. Will maintain contact with Hall RHA Social Chairs (if applicable).
  4. Will maintain a historical record of IRHA sponsored activities and programming.
  5. Will regularly meet with the IRHA Advisor.
  6. Will attend all Interhall Legislature meetings.
  7. Will attend all IRHA Executive Council meetings.
  8. Will perform all necessary acts to further the development of residence hall living.
Part F – IRHA Vice President of Communications Job Description
  1. Will edit and produce an RHA newsletter (The Potty Press) regularly.
  2. Will ensure that the newsletter serves the needs of the students and promotes RHA and residence hall living.
  3. Will publicize and promote RHA through local media.
  4. Will maintain a historical record of all publicity and news items pertaining to RHA.
  5. Will regularly meet with the IRHA Advisor.
  6. Will attend all Interhall Legislature meetings.
  7. Will attend all IRHA Executive Council meetings.
  8. Will assist the VP of Programming when necessary.
  9. Will perform all necessary acts to further the development of residence hall living.
Part G – IRHA Vice President of Business Job Description
  1. Will maintain IRHA finances in both a timely and accurate fashion.
  2. Will balance the ledger to the SYBAS each month.
  3. Will prepare a semester budget with the advice of the IRHA President and Advisor.
  4. Will assist with the training of Hall RHA Treasurers and act as a resource.
  5. Will maintain contact with Hall RHA Treasurers through regularly scheduled group meetings.
  6. Will regularly meet with the IRHA Advisor.
  7. Will attend all Interhall Legislature meetings.
  8. Will attend all IRHA Executive Council meetings.
  9. Will perform all necessary acts to further the development of residence hall living.
Part H – IRHA Vice President of Technology Job Description
  1. Will be responsible for maintaining and updating the Interhall RHA web page under the advisement of the IRHA Advisor.
  2. Will assist in document creation as necessary.
  3. Will be responsible for checking out, checking in, and maintaining all Interhall equipment.
  4. Will regularly meet with the IRHA Advisor.
  5. Will attend all Interhall Legislature meetings.
  6. Will attend all IRHA Executive Council meetings.
  7. Will perform all necessary acts to further the development of residence hall living.

SECTION II : Impeachment
The impeachment of an IRHA Executive Council member will require the presentation of a petition to the IRHA Advisor containing the signatures of ten percent of the RHA membership. A written rationale for impeachment must also accompany this petition. The IRHA Advisor shall call together a committee headed by the IRHA President. The committee shall be headed by the Vice President of Personnel if the impeachment process is taken against the IRHA President. If the committee finds grounds for an impeachment, a vote shall be put forth to the RHA Membership requiring a two-thirds (67%) majority to impeach the officer.
SECTION III : IRHA Executive Council Advisor
The Professional Resident Director (PRD) of Student Leadership shall be the Interhall RHA Executive Council Advisor. He/she will assist the IRHA Executive Council in any way that is necessary for the IRHA to run smoothly. The IRHA Advisor will authorize all charges to the IRHA account(s). The IRHA Executive Council Advisor will not vote in any sort of vote except to break a tie at an IRHA Executive Council Meeting.
SECTION IV : Replacement of IRHA Executive Council Members
Part A – IRHA President
Should the IRHA President be unable to perform his/her functions, the IRHA Vice President of Personnel will fill the position until the IRHA President can again perform his/her functions. If the period of inability of the IRHA President to perform his/her functions is indefinite (defined as longer than the President's term of office) the IRHA Vice President of Personnel shall take over all the duties of the IRHA President for the remainder of the presidential term of office.
Part B – Other IRHA Executive Council Members
The replacement of other IRHA Executive members within a term of office shall fall under the guidelines for emergency elections as outlined in ARTICLE 8 SECTION 2 of the Constitutional By-Laws.
ARTICLE VII: IRHA LEGISLATURE
SECTION I : Legislature Membership
Each hall shall preferably have three senators represent the hall at the IRHA Legislature meetings. Any member of a Hall RHA Executive Council may fill one of the three seats of representation. Only these designated people may vote if a vote is called before the IRHA Legislature.
SECTION II : Meetings
IRHA Legislature meetings will occur once every week except during the beginning and ending of each semester. These meetings shall be held in the Interhall Conference Room in the Interhall RHA Offices at Hannon Hall unless specified by the IRHA Executive council. Interhall Legislature meetings may be cancelled by the IRHA Executive council without vote from the IRHA Legislature. Meetings shall be called to order by the IRHA President. The structure of the meeting will be run under a modified version of Parliamentary Procedures/Robert's Rules of Order.
SECTION III : Meeting Time Limit
No IRHA Legislature Meeting shall take more than one hour, fifteen minutes (75 minutes) from the time that it begins. If the IRHA Legislature wants to continue the meeting, a 2/3 (67%) simple majority vote will allow the meeting to continue.
SECTION IV : Quorum
A quorum (representation from at least five residence halls) must be present to call/pass legislation. A IRHA Legislature meeting without a quorum will be for informational purposes only.
SECTION V : Additional Meetings
Any meeting of the Interhall Legislature other than the regularly scheduled Interhall Legislature meeting (A.VII,S.II) must be known to the halls no later than twenty-four (24) hours before the meeting is called to order. If not all the halls have been contacted, the special meeting cannot take place.
ARTICLE VIII: ELECTIONS
SECTION I : Compliance with Election Guidelines
IRHA and each Hall RHA shall initiate elections in accordance to the established RHA Constitution and Constitutional By-law (A.VIII,S.II) guidelines. Each Floor RHA is not bound to the compliance of these guidelines. The IRHA VP of Personnel as advised by the IRHA Advisor and IRHA President will determine guidelines for any election or vote. These guidelines, for working purposes, are to be considered a Part of the Constitutional By-laws and shall not take precedence over or be in conflict with the Constitution or pre-established Constitutional By-laws. If the IRHA Legislature feels that a established guideline is unfair, a 2/3 (67%) majority roll vote will abolish the rule. The IRHA VP of Personnel as advised by the IRHA Advisor and IRHA President will form an appeals hearing body in the event an appeal to an election is made.
SECTION II : Election Guidelines
All applicants will have ample opportunity to present themselves as candidates. All RHA members are viable candidates unless otherwise stated. A quorum must be present in accordance to either Interhall or Hall constitution guidelines. The candidate with the most votes cast will be elected.
ARTICLE IX: FUNDING
SECTION I : Social Fees
Each resident assigned to live within the residence halls will be charged a social fee. This fee will be $10.00 per semester. $5.00 will go into the IRHA account and $5.00 will go into the individual resident's hall account.
SECTION II : Floor Funds
Each residence hall floor may maintain an individual account within their hall RHA account. Each Hall RHA will determine if any hall funds are to be reserved for these accounts. Floor fund utilization will be approved by the hall's Resident Director and hall RHA Advisor before use.
SECTION III : IRHA Fund Requests
Part A - Procedure : A request to receive money from the Interhall RHA may be made by any hall, floor or individual. The requestor must submit a formal written request which will include the amount asked for, the nature of the request, the breakdown of expenses and the current hall balance.
Part B - Timeline : All fund requests must be present in a timely fashion at the Interhall RHA Executive Council meeting immediately preceding the Interhall RHA Legislature meeting in which the funds will be requested.
Part C - Completion : Fund requests will be copied 35 times and presented at the weekly IRHA Legislature meeting. It will then be voted on by the RHA legislature, passing with a simple majority vote (51%).
SECTION IV : Hall RHA Fund Requests
A request to receive money from a hall RHA may be made by an individual, floor RHA, another hall RHA or IRHA. The procedure to submit this request will be determined individually by each hall RHA.
ARTICLE X: OFFICER CONDUCT
SECTION I : Hall Officer Conduct
If the violation of conduct is from a Hall RHA officer the conduct violation will be brought to the attention of the Hall RHA Advisor, the hall's Resident Director and Interhall RHA Advisor. The Resident Director will meet with the violating officer and it shall be determined if the officer will be removed from his/her position. Hall RHA Officer Removal must meet final approval from the Interhall RHA Advisor. Removal due to violations of acceptable officer conduct as deemed necessary by the aforementioned parties may be immediate and does not follow the procedure of Recall as indicated in A.X. of the Constitution and A.XI.S.III. of Constitutional By-laws.
SECTION I : Interhall Officer Conduct
If the violation of conduct is from an Interhall RHA officer the conduct violation will be brought to the attention of the Interhall RHA Advisor and Director of Residence Life. The Advisor will meet with the violating officer and it shall be determined if the officer will be removed from his/her position. Interhall RHA Officer Removal must meet final approval from the Director of Residence Life. Removal due to violations of acceptable officer conduct as deemed necessary by the aforementioned parties may be immediate and does not follow the procedure of Recall as indicated in A.X. of the Constitution and A.XI.S.III. of Constitutional By-laws.
ARTICLE XI: INITIATIVE, REFERENDUM AND RECALL OF LEGISLATION
SECTION I : Initiative
A petition bearing the signatures of five percent of the RHA members is necessary to bring the initiative before the IRHA Legislature. All petitions must be filed with the IRHA Vice President of Personnel. To be ratified, all such legislation must receive a simple majority (51%) of the votes cast.
SECTION II : Referendum
A bill submitted to the floor of the IRHA Legislature which receives a majority vote of two-thirds (67%) of the Legislature will be submitted to the RHA members for a vote. In order for the legislation to be ratified, it must receive a simple majority (51%) of the votes cast.
SECTION III : Recall
A petition signed by no less than ten percent of a hall's residents shall be filed with the IRHA Vice President of Personnel, along with a written rationale for the recall. A recall election of the hall's membership resulting in two-thirds (67%) majority of the votes cast will be sufficient for recall.
ARTICLE XII: AMENDMENTS
SECTION I : Constitutional Amendments
Amendments to the Constitution may be proposed by a two-thirds (67%) vote of the IRHA Legislature or a petition bearing the signatures of ten percent of the RHA membership. A vote shall be taken of the RHA membership with the petition becoming an amendment with 1.) a simple (51%) majority of votes cast, 2.) the signatures of the IRHA President and IRHA Vice President of Personnel to verify the vote and 3.) the signature of the IRHA Advisor to finalize ratification.

ARTICLE XIII: RATIFICATION AND ENACTMENT
A vote shall be put forth to the IRHA Legislature for adoption of the Constitutional By-laws of the Residence Hall Association of Montana State University-Bozeman. These By-laws, dated April 2, 2008, shall supersede all previous Constitutional By-laws and shall become effective with 1.) two-thirds (67%) majority of ballots cast in favor of ratification and enactment 2.) the signatures of the President of Interhall RHA and the Vice-President of Personnel to verify the vote and 3.) the signature of the Coordinator of Student Leadership to finalize ratification.
ARTICLE XIV: RHA EQUIPMENT
Part A – Procedure:
The use of equipment (sound system, projector, and digital camera) for use by the residence halls is provided at no cost by IRHA. A request for usage of equipment must be made through the website, http://www.montana.edu/interhall/. An email response will be returned as per the request of equipment. The equipment must be checked out to a responsible party with the hall ARD or RD, and a member of the Interhall Executive team. All forms must be in progress before removal of equipment from the offices. All forms must then be completed upon return of the equipment to the Interhall offices. Upon the return of equipment to the Interhall offices, it must be returned organized and neatly, including cables wound accordingly.
Part B – Timeline:
Equipment designated for use by respective floor or hall RHA’s for relevant events will need to make a request no later than 3 days preceding the event. Events designated as pertaining to Residence Life activities will need to make a request no later than 5 days preceding the event. Equipment must be returned no later than 48 hours after event unless otherwise specified by VP of Tech.
Part C – Consequences and Fines:
The responsible party as listed per check out will be held liable for all equipment. Any missing or damaged equipment will be charged to the individual or their hall if the respective event was hall or campus wide. Failure to notify the current Interhall VP of Technology of missing or damaged components will result in the prior responsible party listed to be billed. Any damaged component that takes the Interhall VP of Technology longer than 1 hour to correct will be charged to the responsible parties at $10.00/hour.
Failure to make a request for equipment, be negligent in the return of said equipment, or not have a designated member of Interhall RHA present during check out will result in consequences. First time violation will be $25.00. A second subsequent violation will be $50.00 and an individual’s removal of privileges for one month. A third violation will result in a $100.00 fine and an individual permanent loss of privileges up to the completion of the semester. These consequences will be applied individually if it is determined it was a particular individuals fault. If this does not apply or the individual is unable to abide by the punishment, the hall will receive the inferred penalties.
