ITEM 92-1007-R0796--Authorization to Proceed, Series D 1996 New Money Issue; The University of Montana (REVISED)

BOARD ACTION: Approved unanimously September 19, 1996 (Butte).

THAT: The Board of Regents of the Montana University System adopts the Preliminary Bond Resolution for the Series D 1996 Facilities Improvement Bonds for The University of Montana, and authorizes the Office of the Commissioner and The University of Montana to proceed with the planning for a new money issue for the following projects:

The University of Montana (all campuses):

Classroom/Laboratory Renovations Including Handicap Access--$7,000,000 (Bond Proceeds)--$7,000,000 (Total)

The University of Montana-Missoula:

Lodge Renovations--$1,800,000 (Bond Proceeds)--$1,800,000 (Total)

Supplemental Funding, Fieldhouse Renovations--$6,500,000 (Bond Proceeds)--$4,500,000 (Private Funding)--$11,000,000 (Total)

Montana Tech of The University of Montana:

100-Bed Residence Hall--$4,000,000 (Bond Proceeds)--$4,000,000 (Total)

Western Montana College of The University of Montana:

Residence Hall/Dining Services Renovation--$4,550,000 (Bond Proceeds)--$4,550,000 (Total)

Family Housing Renovations--$200,000 (Bond Proceeds)--$200,000 (Total)

Land Acquisition--$135,000 (Bond Proceeds)--$135,000 (Total)

TOTAL: $28,685,000 ($24,050,000--Bond Proceeds; $4,500,000--Private Funding)

EXPLANATION: The revised authorization includes $7,000,000 for the remodeling of classrooms and laboratories, including handicapped access, on the four campuses of The University of Montana and $135,000 for land acquisition at Western Montana College of The University of Montana.

ITEM 92-1004-R0996--Certificate of Completion, Land Acquisition Phase I, Series A 1993 Facilities Improvement and Refunding Revenue Bonds; The University of Montana-Missoula

BOARD ACTION: Approved unanimously September 19, 1996 (Butte).

THAT: The Board of Regents of the Montana University System authorizes The University of Montana to deliver to the Trustee for the Series A 1993 Facilities Improvement and Refunding Revenue Bonds of The University of Montana a Certificate of Completion for the Land Acquisition Phase I project.

EXPLANATION: Section 5.01© of the Indenture of Trust for the Series A 1993 Facilities Improvement and Refunding Revenue Bonds provides that, within 90 days after the completion of each project, The University of Montana, on behalf of the Board of Regents, shall deliver a Certificate of Completion to the Trustee. The certificate must state that the project has been fully completed in accordance with the plans and specifications and that the project has been fully paid for and no claim or claims exist against the Board. Attached is the draft of the certificate which will be executed upon approval of the Board of Regents.

ITEM 92-1005-R0996--Certificate of Completion, Mortgage Refinancing Project, Series C 1995 Facilities Improvement and Acquisition Revenue Bonds; The University of Montana-Missoula

BOARD ACTION: Approved unanimously September 19, 1996 (Butte).

THAT: The Board of Regents of the Montana University System authorizes The University of Montana to deliver to the Trustee for the Series C 1995 Facilities Improvement and Acquisition Revenue Bonds of The University of Montana a Certificate of Completion for the Mortgage Refinancing project.

BOARD ACTION: Approved unanimously September 19, 1996 (Butte).

THAT: The Board of Regents of the Montana University System authorizes The University of Montana to deliver to the Trustee for the Series A 1993 Facilities Improvement and Refunding Revenue Bonds of The University of Montana a Certificate of Completion for the Stadium Meeting and Locker Rooms project.

BOARD ACTION: Approved unanimously September 19, 1996 (Butte).

THAT: The Board of Regents of the Montana University System authorizes The University of Montana to deliver to the Trustee for the Series A 1993 Facilities Improvement and Refunding Revenue Bonds of The University of Montana a Certificate of Completion for the Washington-Grizzly Stadium Renovations project.

EXPLANATION: Section 5.01© of the Indenture of Trust for the Series A 1993 Facilities Improvement and Refunding Revenue Bonds provides that, within 90 days after the completion of each project, The University of Montana, on behalf of the Board of Regents, shall deliver a Certificate of Completion to the Trustee. ITEM 92-1011-R0996--Academic Facilities Fee; The University of Montana

BOARD ACTION: Approved September 19, 1996 (Butte). Regent Pat Davison voted against the motion.

THAT: The Board of Regents of the Montana University System authorizes The University of Montana to assess a mandatory Academic Facilities Fee on all students, resident and non-resident, effective Fall Semester 1997 as follows (per semester full-time student):

$24.21--The University of Montana--Missoula

$25.14--Montana Tech of The University of Montana

$23.19--Western Montana College of The University of Montana

$20.58--Helena College of Technology of The University of Montana

EXPLANATION: The revenue from the Academic Facilities Fee will provide the resources to repay the debt on the $7,000,000 included in the Series D 1996 Facilities Improvement revenue bond.

ITEM 92-1602-R0996--Authorization to Negotiate Lease-Purchase Construction of a 16-32 Unit Family Housing and Acquisition of the Land on which the Units would be Constructed; Western Montana College of The University of Montana.

BOARD ACTION: Approved unanimously September 19, 1996 (Butte) as amended. Amendment: Insert language stating that the final proposal would be subject to Regents' approval and the outcome of the previously approved Request for Proposal (RFP) process.

THAT: The Board of Regents of Higher Education authorizes Western Montana College of The University of Montana to plan and negotiate with a private construction firm the purchase of land and the construction of 16 - 32 family housing units on the land. The final proposal would be subject to Regents' approval.

EXPLANATION: A WMC-UM donor, alumnus, and building contractor has offered to assist WMC-UM in acquiring approximately three acres adjacent to the campus within Western's approved acquisition zone, for the purpose of building 16-32 family housing units and additional campus parking spaces. The buildings would be leased to and managed by WMC-UM. The entire property, land and building(s), would be deeded to Western at the end of the agreed-upon lease period. Western has a substantial, long-standing waiting list of students desiring to live close to campus in family housing. Western has not been able to meet this demand because it does not own sufficient land near the campus. This authorization would permit Western to negotiate a proposal with the private contractor subject to approval of President of The University of Montana and the Board of Regents. The project, if ultimately approved, has the potential to acquire much-needed land and housing units of high quality in cooperation with the private sector. It is highly unlikely that WMC-UM could otherwise provide additional affordable housing units for student families.

ITEM 92-1603-R0996--Property Acquisition; Western Montana College of The University of Montana

BOARD ACTION: Approved unanimously September 19, 1996 (Butte) as amended. Amendment: Insert language stating that the final purchase of the parcel would require two appraisals and the approval of the President and Commissioner.

THAT: The Board of Regents of Higher Education authorizes Western Montana College of The University of Montana to negotiate the purchase of property adjacent to the campus for the purpose of private construction of family housing.

EXPLANATION: Approximately 2.86 acres adjacent to the campus has recently come on the market for $125,000. This land is included in the Regents' approved acquisition zone but does not have a residence capable of supporting the purchase with rental income. The University of Montana Series D bond includes funding for this purchase with the debt service to be paid through the interest and income on the state land grant which is pledged to the bond indenture. An appraisal of the property has been requested but is not yet available.

Western Montana College of The University of Montana is exploring two similar methods of constructing needed family housing on this property: either through the request for proposal for private construction and leaseback process already provided by The University of Montana or through an arrangement with a WMC-UM donor, alumnus as outlined in ITEM 92-1602-0996.

Western has a waiting list for family housing. Construction on this parcel would provide for 16-32 needed family housing units.

Final purchase of this parcel will require the approval of the President and Commissioner as per the approved acquisition zone policy: ITEM 88-1601-R0795.

ITEM 92-1902-R0996--Authorization to Expend up to $45,000 of Computer Fees; Helena College of Technology of The University of Montana

BOARD ACTION: Approved unanimously September 19, 1996 (Butte).

THAT: The Board of Regents of Higher Education authorizes Helena College of Technology of The University of Montana to expend up to $45,000 of computer use fees for the upgrading of computer equipment in a microcomputer classroom/lab.

EXPLANATION: This expenditure will provide an upgrade from 286 computers to new Pentium microprocessors and current software for a student microcomputer lab, and allows Windows and Windows 95, as well as other applications for compatible software.
